TERMS OF SERVICE

Thank you for using Boost products and services (“Services”), in our pursuit of making all Hashimoto’s patients lives easier we keep your data privacy one of our highest priorities. By downloading the app or by using our conversational AI (chatbot), you accept these Terms and Conditions (“Terms”). It is important for you to read through the Terms and if you do not agree with them, you should not install or use Boost app or messenger. The following Terms and End User License Agreement (“EULA”) constitutes an agreement between you and Boost by VLM Health UG.

About Boost

Boost is a service developed by VLM Health UG, company registered in Germany. Boost Services are available on the “Test Flight” as “Boost Health” for iPhone and in the Google Play Store as “Boost Health” for Android phones, as well as on Facebook messenger as “Hashiboto” for all the devices supporting Facebook messenger. The purpose of Boost is to help our users with autoimmune diseases to record their symptoms, to track their health status as well as to get scientific information on their condition.

Using our Services

The Service is only available for users private use as a license, and is not intended for commercial use (e.g. sublicensing). Using Services, as permitted by the law and these terms you agree to hold a sole responsibility for all activities on your device. Boost is not in any way responsible for any loss or damage caused by unauthorised access to your device. If you suspect any unauthorised use, please inform Boost customer service immediately.

To use Boost, you must be at least 13 years old. Boost is not intended for use by individuals under the age of 13.

If you have any feedback or criticism regarding Boost app or services, please firstly contact us to help us improve.

Boost reserves the right to contact you via e-mail, mobile phone app notifications or other media related to your beta testing of Boost.

Boost retains all right, title and interest in and to the Boost Services, including, but not limited to, all copyrights, trademarks, trade names, patents, titles, computer codes. The Boost Service may not be copied, reproduced or distributed in any manner or medium, in whole or in part, without prior written consent from Boost.

SCIENTIFIC HEALTH INFORMATION

Your healthcare provider and you are responsible for taking good care of your health. Boost is not a medical organization, and as such will not provide you with any medical advice, medical diagnostics or treatment. The purpose of Boost Services is to help our users to remind them to take their medication on time, record their symptoms, get information from peer-reviewed scientific publications and how to follow certain lifestyle adjustments, as well as to track how do the symptoms change in time.

Information made available through Boost Service should be used for educational and recreational purposes. Boost cannot guarantee for any health improvements, you should always consult with your doctor before making changes to your lifestyle. Boost is not responsible for any personal damages that may be a result of any (mis)use of Boost Services.

INTELLECTUAL PROPERTY

All rights in and to the Services, including any trademarks, service marks, trade names and copyrighted content (collectively “Intellectual Property”) presented within the Service are the property of Boost. You agree not to use Intellectual Property for any other purposes except for your use of the Service, unless required otherwise by applicable mandatory law.
By submitting User Data to Boost, you agree to grant Boost a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use private User Data to the extent necessary for Boost to operate and maintain Boost Service. This license shall remain valid until the respective User Data is deleted from the Service by you or by Boost in accordance with these Terms.

DISCLAIMER

You use Boost Service at your own risk. The Service is provided “AS IS”, without any warranties, and Boost does not warrant that the Service and availability thereof will be uninterrupted or error free. Boost does not assume any responsibility for errors or omissions in the information or software or other documents.
In no event shall Boost be liable for any indirect or consequential damages, except in cases of intentional misconduct or gross negligence.

MISCELLANEOUS

You are not entitled to assign your rights and/or obligations under these Terms or use of the Services to any third party without Boost’s prior written consent. Boost is entitled to assign its rights and/or obligations under these Terms.
Boost reserves the right to refuse the Service to anyone for any reason at any time. Boost may revise these Terms from time to time and the most current version will always be posted on Boost’s website (www.boosthealthapp.com). Any and all material changes shall become into effect between you and Boost upon your acceptance of such changes (e.g. by using the Services after such notification has been made to you).

GOVERNING LAW AND DISPUTE RESOLUTION

These Terms and the use of the Services are governed by the laws of Germany. All claims arising out of or relating to these Terms or the Service shall be resolved by the German courts, whereby the District Court of Berlin shall be the court of first instance.

PRIVACY POLICY

Boost mission is provide Hashimoto’s patients with a full control over their health through enabling individuals to record and track own symptoms, get scientifically correct information, implement and track the benefit of changes in own lifestyle and facilitate conversation one might have with other patients or doctors.
Our Privacy Policy explains what personal information we collect and share when you use the Services.
BY USING THE SERVICES YOU CONSENT TO THE COLLECTION, USE AND TRANSFER OF YOUR DATA FOR PROCESSING AS DESCRIBED IN THIS PRIVACY POLICY.
By using our Services and providing information to us, you consent to the transfer to and processing of the information in the EU and the USA.
Please read this Privacy Policy carefully, as your access to and use of the Services signifies that you have read and agree to all terms of this Privacy Policy. If you do not agree with any part of this Privacy Policy or our Terms and Conditions, please do not access or continue to use any of the Services or otherwise submit your Personal Data.

WHO WE ARE

Boost is operated by VLM Health UG , a German corporation, located in Berlin. We provide mobile application based service and conversational AI interface.

INFORMATION WE COLLECT

Boost collects information to operate our business and provide you with innovative solutions for managing symptoms and lifestyle connected to Hashimoto’s.
Mobile phone application
For Boost beta mobile application version we will not collect Personal Data. We will collect Other Information.
1. “Personal Data” is information that can be used, directly or indirectly, alone or together with other information, to identify you as an individual.
2. “Other Information” is information that is de-identified, anonymous and aggregated, and does not reveal your identity. We collect and use this information to understand how you use our Services and constantly improve, innovate and build a product to reflect your needs.
We may collect Other Information about your use of Boost Services, including for example your device type, date and time of access as well as how you interact with the Services (what app screens you viewed or interacted with and the length of the time spent on them).
When using Boost Beta version, all of your data is stored on your device, and we won’t have access to it. However, we will receive usage data provided by your device while you are using Boost (e.g. mobile operating system Android or iOS/iPhone, your IP address, app usage data).
Conversational AI (chatbot)
For Boost conversational AI (aka a chatbot) we will collect Personal Data and Other Information. We will not ask users for any medical data or any medical data obtained from the healthcare professionals, such as lab tests or any diagnosis person might have received.
1. “Personal Data” is information that can be used, directly or indirectly, alone or together with other information, to identify you as an individual (your name, Facebook ID, time zone and your gender). This is further described: https://developers.facebook.com/docs/messenger-platform/user-profile.
2. “Other Information” is information that is de-identified, anonymous and aggregated, and does not reveal your identity. We collect and use this information to understand how you use our Services and constantly improve, innovate and build a product to reflect your needs.
We may collect Other Information about your use of Boost Services, including for example your device type, date and time of access as well as how you interact with the Services (what you viewed or interacted with and the length of the time spent).
When using Boost chatbot, all of your recorded data is stored on AWS (Amazon Web Services) and separate from your identifiable data. In addition, we will receive usage data provided by your device while you are using Boost (e.g. mobile operating system, your IP address and bot usage data).
We are using Facebook messenger as a conversational interface tool. Chatbots are less organized and less protected ways to communicate and share your data. While your messages are encrypted in transit, they are not end-to-end encrypted. This means that the provider of service, in this case, Facebook, can store or access any or all of the information from the chatbot. Your data will not be visible to other chatbot users.

SURVEYS

Surveys will be geared towards advancing scientific knowledge on Hashimoto’s , and as such may be done in partnership with one of our academic university collaborators, other types of surveys will have an aim to improve our Services. We will launch survey to ask you questions about a range of topics. When you take surveys we may ask you to provide your Personal Data, such as e-mail, age and other information that are necessary to the survey. Participation in surveys is not obligatory, and every time you will be asked for consent to participate.
We may collect your Personal Data when you submit content (e.g. contacting support or leave review).

ANALYTICS

For the Boost app, we use a data analysis service operated by Firebase, which analyses your use of the Boost app. Your app usage data will be transferred and stored on a server in the USA operated by Firebase by Alphabet, Inc.
For Boost conversational AI we use a data analysis service operated by Facebook. Your Facebook messenger data will be transferred and stored on a server in the USA operated by Facebook, Inc.
By using Boost Services you are deemed to have expressly consented to the use and processing of your data collected by Firebase and Facebook described above.

HOW WE USE PERSONAL DATA

We will use your personal data to communicate with you, build a better experience for you, provide you with a more personalized experience, tailor made analytics and relevant information. We will use the data we collect to provide the Services we offer, including providing you with all of the information, content and features of Boost Services.

One of our goals is to forward science in the area of autoimmune diseases. So far there are virtually no large-scale datasets available to academic research, and Boost will help in the future by providing anonymized data for such a research.

HOW WE DISCLOSE PERSONAL DATA

Boost will not disclose any of your Personal Data from beta app or conversational AI usage.

INFORMATION SAFETY

Boost highly values your Personal Data safety and is committed to protect it. To do so we use data safety recommendations from the safety bodies and have designed measures to protect your information against unauthorised access, theft or loss.
